1. Scope and Operator

These General Terms and Conditions (GTC) govern the use of the website operated by Tickets Vienna and all ticket purchases made through it. By placing an order, you accept these terms in full.

2. Service Description

Tickets Vienna is a ticket brokerage platform that acts as an intermediary between ticket buyers and event organizers or venues. We facilitate the sale of tickets to cultural events, concerts, and performances in Vienna and surrounding areas.

The contractual relationship for the event itself exists between you (the buyer) and the event organizer. Tickets Vienna is responsible solely for the ticket sales process, delivery, and related customer support.

Vendor and partner portal functions are provided for event organizers, venues, and commercial partners. These partner functions may be subject to separate agreements or commission arrangements.

3. User Accounts

Account registration is optional. You may purchase tickets as a guest. If you create an account, you are responsible for keeping your login credentials confidential. You must provide accurate and complete information.

We reserve the right to suspend or delete accounts that violate these terms or are used for fraudulent activity.

4. Ordering Process

The ticket purchase process works as follows:

1. Select an event, date, and ticket type, then add the tickets to your shopping cart.
2. Tickets are held in your cart for 30 minutes. If you do not complete checkout within this time, the tickets are released back for sale.
3. Provide your personal details (name, email, delivery address if applicable).
4. Choose a delivery method and complete payment.
5. After successful payment, you receive a confirmation email with your tickets or instructions.

Your order becomes binding upon successful payment. All bookings are subject to availability.

5. Prices and Payment

All prices are displayed in EUR and include applicable taxes and fees unless stated otherwise. The total amount shown at checkout is the final price you pay.

The payment methods available for a specific order are shown during checkout and may include:

• Credit and debit cards, digital wallets, and local payment methods processed securely through Stripe, where enabled.
• PayPal, where enabled.
• Manual or pay-after-confirmation options, only if expressly offered at checkout.

Payment is processed securely by third-party payment providers. We do not store your card details. See our Privacy Policy for more information.

6. Ticket Delivery

For most ticket orders, digital e-ticket delivery is the standard delivery method. If postal delivery is offered for a specific order, delays caused by postal or courier services may be outside our control.

7. Right of Withdrawal

In accordance with Article 16(l) of the EU Consumer Rights Directive (2011/83/EU) and Section 18(1)(10) of the Austrian Consumer Protection Act (FAGG), tickets to events taking place on a specific date or within a specific period are exempt from the 14-day right of withdrawal.

This means that once your ticket purchase is confirmed, you do not have a statutory right to cancel or return the tickets under the EU cooling-off period. This exemption applies because event tickets are for leisure services provided on a specific date.

By completing your purchase, you acknowledge and agree that the right of withdrawal does not apply to your ticket order.

8. Cancellation and Refunds

8.1 Standard Tickets

Standard tickets are generally non-refundable. Specific cancellation policies may apply depending on the event and venue. These policies are displayed on the event page before purchase.

8.2 Flexible Tickets

Some events offer flexible tickets at a premium price. Flexible tickets may be cancelled for a full refund up to the deadline specified on the event page. After the deadline, flexible tickets become non-refundable.

8.3 Event Cancellation by Organizer

If an event is cancelled by the organizer, you are entitled to a full refund. We will notify you by email and process the refund to your original payment method.

8.4 Refund Process

Refund requests are reviewed by our team. Approved refunds are processed to the original payment method. Processing times depend on your bank or payment provider and may take up to 14 business days.

9. Gift Coupons

Gift coupons can be purchased and redeemed toward any ticket purchase on our website. Gift coupons are applied during checkout and reduce the order total by the coupon amount.

• Gift coupons cannot be exchanged for cash.
• Each gift coupon can be used only once.
• If the order total is less than the coupon value, the remaining balance is forfeited.
• Gift coupons are non-refundable.

10. Discount Coupons

We may issue promotional discount coupons from time to time. Discount coupons are subject to the following conditions:

• Valid only within the specified date range (if applicable).
• Subject to usage limits and minimum order requirements as specified.
• Cannot be combined with other coupons unless stated otherwise.
• May not be resold or distributed without authorization.

11. Reviews

After attending an event, you may be invited to leave a review of our booking service. Submitting a review requires your explicit consent for publication. Your name will be displayed in anonymized form (e.g. first name and initial).

You may withdraw your consent and request removal of your review at any time by contacting us. Reviews must be truthful and based on genuine experience. We reserve the right to remove reviews that are abusive, defamatory, or unrelated to the service.

12. Liability

Tickets Vienna acts as an intermediary between buyers and event organizers. The event organizer is responsible for the performance, content, timing, and execution of the event.

We are not liable for event cancellations, schedule changes, the artistic or operational quality of the event, personal injury or property damage at the event venue, or delivery delays caused by third-party carriers where non-digital delivery is offered.

Our liability is limited to the ticket purchase price in all cases except where mandatory law provides otherwise. Nothing in these terms limits liability for intent, gross negligence, or personal injury caused by our fault.

13. Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of Tickets Vienna or its content suppliers and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works without written permission.

14. Newsletter

You can subscribe to our newsletter to receive updates about events and special offers. Subscription is voluntary and you can unsubscribe at any time by using the unsubscribe link in the email or by contacting us.

15. Governing Law and Jurisdiction

These terms are governed by the laws of the Republic of Austria, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For consumers resident in the EU, mandatory consumer protection laws of your country of residence apply to the extent they provide greater protection. The courts of Vienna, Austria, have jurisdiction, except where mandatory law grants jurisdiction to the courts of the consumer's domicile.

16. Dispute Resolution

If you have a complaint or dispute, please contact us first so we can try to resolve the matter directly.

Where consumer dispute resolution is available under applicable law, consumers may use the competent national consumer arbitration channels.

17. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that achieves the economic purpose of the original provision as closely as possible.
